AudioKit Terms of Service

Effective date:

1. Scope and Acceptance

These Terms of Service apply to your use of the AudioKit application and its features. “We,” “us,” and “our” refer to the operator, AudioKit. “You” refers to the person using the application.

Please read these Terms and the AudioKit Privacy Policy before using the application. By starting or continuing to use the application after having an opportunity to review these Terms, you agree to them. Where separate express acceptance is required, we will obtain it as required. If you do not agree, please stop using the application.

2. Application Features

AudioKit is an on-device audio processing tool. Its features include audio import, playback previews, format conversion, trimming and splitting, speed and volume adjustment, fade-in and fade-out, audio merging, extraction of audio tracks from video, and file management and export. Available features depend on the version you install.

The application currently does not require an account. Core media processing takes place on your device. We do not provide server hosting or an online backup service for your media files. You are responsible for managing your original files, resources stored in the application, and exported results.

3. Eligibility

You must be able to understand and accept these Terms. If you do not have the capacity to accept them independently, use the application with the consent and guidance of a parent or other guardian.

4. Your Content and Rights

Using the application does not transfer to us any rights you hold in imported audio, video, or generated content. Reading, copying, converting, and saving files is solely for carrying out the operations you select. It does not grant us a right to use your content for promotion, sale, or unrelated purposes.

You must have the rights or permissions necessary to process and use the content, including any relevant copyright, privacy, and other rights. Importing, editing, extracting, or converting a file does not automatically give you permission to distribute, sell, or otherwise use its content.

Do not use the application to infringe another person’s rights, process or distribute private content without authorization, commit fraud or other unlawful acts, or bypass content access restrictions that you are not entitled to bypass. You are responsible for the files you select, the operations you perform, and your subsequent use of the results.

5. Software License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to install and use the application on your own devices for lawful audio processing.

Rights in the application’s software, interface, icons, and other content supplied by us belong to AudioKit or their respective rights holders. These Terms do not transfer those rights or affect your rights in your own media content.

Without permission from the relevant rights holder, you may not sell or redistribute the application, remove rights notices, or interfere with its normal operation. These restrictions do not prevent you from exercising non-waivable statutory rights or rights separately granted by the relevant rights holder.

6. File Management and Processing Results

When you import audio, the application normally copies the selected files into app-specific storage. Processing results are also stored there, and you can export them to a location you choose. Deleting a file from the application’s library normally deletes only the copy stored by the application, without also deleting the original file or previously exported copies.

Clearing application data or uninstalling the application will normally remove its app-specific files from the device. Export and independently back up important files. We cannot restore these local files for you from a server.

Media processing may change audio quality, duration, volume, file size, format, or metadata. Some files may be unreadable or unsupported because of their encoding, corruption, encryption, or device limitations. We do not guarantee support for every file or that results will meet your particular needs. Keep original files and review processing results before using or distributing them. Check the destination and file name when exporting to avoid overwriting files you still need.

7. Privacy and Data Processing

The AudioKit Privacy Policy explains how we handle selected media files, related file information, and information you voluntarily send when contacting us. Please read it for details about local storage, temporary files, system backups, and deletion.

8. Changes and Availability

We may update the application to improve features, fix problems, or maintain compatibility, and may change or discontinue some features. For changes likely to materially affect normal use or file export, we will provide reasonable advance notice through the application or another appropriate means, except where urgent security fixes or unforeseen circumstances prevent this.

Application operation may depend on device performance, system version, available storage, and the files being processed. We do not promise uninterrupted or error-free operation. Save important files before updating, before support ends, or before you stop using the application.

9. Responsibility and Limitations

We will provide and maintain the application with reasonable care. To the extent permitted, it is provided as available, without warranties beyond these Terms and express product statements.

To the extent liability may lawfully be excluded or limited, we are not responsible for losses caused by your lack of necessary content authorization, incorrect operations, failure to maintain backups, device failure, system problems, or corrupted input files, or for losses without a reasonable causal connection to the application.

These Terms do not exclude or limit liability that cannot lawfully be excluded or limited, including mandatory user protections and liability for intentional misconduct or gross negligence where such liability cannot be excluded. They do not reduce your non-waivable rights.

10. Ending Use

You may stop using and uninstall the application at any time. Export resources you wish to retain before doing so. Use that violates these Terms is outside the scope of the license granted by them.

Ending use does not affect content rights, responsibilities already incurred, or provisions that should continue to apply by their nature.

11. Updates to These Terms

We may update these Terms as features or operations change, and will publish the new version and its effective date within the application. We will clearly notify you of material changes and seek renewed acceptance where required. Updates will not retroactively reduce non-waivable rights you have already acquired.

If you do not agree to updated Terms, you may stop using the application and export files you wish to retain before uninstalling it.

12. Contact and Resolution of Concerns

If you have questions, feedback, or a dispute concerning these Terms or the application, contact AudioKit at aliyanconsole47@gmail.com. We will reasonably address your feedback and try to resolve concerns through communication.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent they can operate independently.
